Federal law makes the U.S. Nuclear Regulatory Commission (NRC) responsible for
regulating a repository at Yucca Mountain. As part of
its responsibility, the NRC developed licensing rules
that implement the Environmental
Protection Agency’s (EPA’s) safety and dose
standards for a repository.
In addition, the law requires the Department of Energy
(DOE) to apply to the NRC for a license
to construct and eventually operate a repository. This
application must present scientifically defensible analyses
of how the repository will perform over 10,000 years.
The NRC will not award a license to the DOE unless
it is satisfied that the repository will meet its own
licensing rules and the EPA’s safety standards
over the 10,000-year regulatory period.
